Companies and internet Hi-Media Rentabiliweb active in online advertising and micro-payment, were both convicted by the Paris Commercial Court after a trial for defamation, unfair competition and parasitism.
According to the decision, dated Friday and sent to AFP Monday, Rentabiliweb is ordered to pay 100,000 euros to Hi-Media for "parasitism" and "vilification" while Hi-Media is ordered to pay 25,000 euros to Rentabiliweb for "elimination of its reference on Wikipedia (...)".
Rentabiliweb Hi-Media was assigned to trial in June 2010 for attempting to delete the reference to its site in the form "micropayment" on the online encyclopedia Wikipedia. The court found that "Rentabiliweb provides clear proof that a person acting under the authority of Hi-Media is the author of the removal." Beyond the charges against Hi-Media, the contributors note that the Wikipedia page "micropayment" and other related pages have been many changes, far from being all to the advantage of Hi-Media in 2009 and 2010.
RENTABILIWEB also condemned:
The court also sentenced Rentabiliweb for having disparaged the end of December 2010 the activity of micro-Allopass, for which Hi-Media is looking for a partner or a buyer, indicating that the branch is "losing ground". The group had said in the press late December 2010 not to be interested in Allopass, even though its president, Jean-Baptiste-Descroix Vernier, had contacted Hi-Media in mid-December 2010 to learn about the subsidiary.
"It is clear that two weeks after expressing his interest Allopass Rentabiliweb can not allow the publication is absolutely not interested. He is not loyal to confirm information about a slowing of Allopass today without being able to provide any basis for this information, "the court judge. "This is as serious acts may decrease the potential interest of other buyers Allopass and therefore the sale price of this activity, and thus have a negative impact" on the share price of 'Hi-Media, he continues.
